Terms & Conditions
These terms and conditions apply to all purchases, sales, and interactions with HVS Online Limited (“HVS”).
1. General Terms
1.1 HVS provides a seamless online platform for purchasing vehicles. By engaging with our services, you agree to these terms and conditions. 1.2 HVS reserves the right to update these terms at any time. Changes will be effective immediately upon posting on our website. 1.3 All vehicles sold by HVS are subject to availability. HVS reserves the right to withdraw or update vehicle listings at its sole discretion.
2. Payments and Pricing
2.1 All vehicle prices are listed in New Zealand Dollars (NZD) and include GST unless stated otherwise. 2.2 Payment must be made in full before vehicle delivery or pickup unless financing is arranged. HVS will only accept cleared funds. 2.3 Additional fees, such as delivery or transfer costs, will be disclosed at the time of purchase and must be paid in full.
3. Delivery and Collection
3.1 HVS offers delivery services at an additional cost, depending on location. Delivery dates are estimated and subject to change due to unforeseen circumstances. 3.2 Customers may collect their vehicles directly from designated HVS locations at no additional cost. 3.3 The risk of the vehicle passes to the customer upon delivery or collection.
4. Trade-In Policy
4.1 Customers may trade in eligible vehicles as part of their purchase. Trade-in values will be assessed and agreed upon at the time of sale. 4.2 Once a trade-in vehicle has been accepted, it will not be returned to the customer under any circumstances. 4.3 If a trade-in vehicle is encumbered, the customer must ensure all liens or encumbrances are discharged before the trade-in is finalized.
5. 7-Day Money Back Guarantee
5.1 The HVS 7-Day Money Back Guarantee applies to HVS Online vehicles only. 5.2 Customers must initiate a claim within 7 days from the date and time of vehicle delivery or collection. 5.3 The vehicle must not have exceeded 500 km during this period. Additional kilometers will incur a charge of $5.00 per km. 5.4 The vehicle must be returned in person to the original HVS location unless otherwise agreed. Returns via phone or email will not be accepted. 5.5 The vehicle must be returned in its original condition, free of damage, modifications, or additional wear. Accessories, spare keys, and manuals must also be returned. 5.6 Refunds are for the vehicle’s purchase price only. Additional products, such as warranties, are non-refundable. 5.7 If the vehicle is encumbered, HVS reserves the right to pay all or part of the refundable amount to a financier to discharge the encumbrance. If the refundable amount is insufficient to cover the encumbrance and the customer elects not to pay the balance, no refund will be provided. Any costs incurred with the financier are the customer’s responsibility. 5.8 Risk remains with the customer until HVS confirms eligibility for the refund and accepts the vehicle.5.9 Upon return, the vehicle will be inspected to ensure compliance with these terms and conditions. Approved refunds will be processed via direct deposit into the customer’s nominated bank account within 10 working days.
6. Warranties and Mechanical Breakdown Insurance (MBI)
6.1 All HVS vehicles come with a complimentary limited warranty covering 100 days or 5,000 km, whichever comes first. 6.2 Additional warranty options, including MBI, are available for purchase at the customer’s discretion. 6.3 Warranty claims must adhere to the terms outlined in the specific warranty agreement provided at purchase.
7. Customer Responsibilities
7.1 Customers are responsible for ensuring accurate information is provided during the purchase process. 7.2 Any legal or financial obligations associated with financing the vehicle must be fulfilled by the customer. 7.3 Customers must comply with all vehicle ownership transfer requirements, including registering the vehicle in their name.
8. Liability and Disputes
8.1 HVS is not liable for any indirect or consequential loss arising from the purchase or use of its vehicles or services. 8.2 Any disputes arising under these terms will be governed by New Zealand law. Parties agree to submit to the exclusive jurisdiction of New Zealand courts.
